The Burn Notice actor was arrested in Miami on July 12, 2009 after the vehicle he was driving nearly collided with another vehicle. The actor refused to take the breathalyzer test when an officer requested him to do so.

"I had three drinks at the Fountain Bleu. I really think I'm only borderline and not too drunk. The only mistake I made tonight was drinking Benadryl with three glasses of wine," Donovan said.
